JUDICIAL:
RANDALL D. BRESEE AND DERRY BRESEE, Appellants, v. LYLE C. BARTON AND VERONICA L. BARTON, Appellees., 2016 UT App 220, involved a water and boundary dispute. Plaintiffs purchased a parcel of land surrounded on three sides by defendant’s land. When plaintiff purchased the parcel, the deed included a fifty-foot ingress, egress, and utilities easement over defendant’s land, but mentioned no other easement. District court found that when plaintiffs claimed a right to condemn an irrigation easement over defendant’s property, they did not “rebut defendant’s evidence that such an easement would cause ‘considerable interference’ with defendant’s water use.” Summary judgment for defendant affirmed.

Rule establishing an exemption from the requirement of a tolerance for residues of 2-pyrrolidinone, 1-butyl when used as an inert ingredient in pesticide formulations applied to growing crops only at a concentration not to exceed 30% by weight under EPA regulations. Details here.
