Judicial:

DARITECH, INC., a Washington corporation, Plaintiff, v. GREG TE VELDE, an individual, formerly doing business as Willow Creek Dairy, & doing business as Lost Valley Farm, Defendant., No. 2:18-CV-00090-SU, 2018 WL 6012367 (D. Or. Nov. 16, 2018);Plaintiff DariTech, Inc., brings this action for breach of contract and related claims against defendant Greg Te Velde, formerly doing business as Willow Creek Dairy, and doing business as Lost Valley Farm, to recover the unpaid balance on dairy farm equipment and services that plaintiff provided defendant. Defendant has not appeared or otherwise taken any action in this matter. The Court entered default on March 6, 2018. Plaintiff filed a Motion for Default Judgment, on which the Court, finding the Motion deficient, ordered supplemental briefing. Plaintiff then filed an Amended Motion for Default Judgment. On April 30, 2018, plaintiff filed a Notice that defendant filed for Chapter 11 bankruptcy on April 27, 2018, in the Eastern District of California.. On August 28, 2018, the Court stayed this matter pending the bankruptcy proceedings. On August 31, 2018, plaintiff filed a Notice that the Bankruptcy Court had approved relief from the automatic stay of bankruptcy.
On November 15, 2018, plaintiff filed an Unopposed Motion for Entry of Judgment Consistent with Stipulation between Parties and Order of Bankruptcy Court. Pursuant to the stipulation between the parties, the parties move for this Court to enter Judgment in favor of plaintiff and against defendant in the amount of $396,271.47. The Court grants plaintiff’s motion.

EAGLE FRUIT TRADERS, LLC, Plaintiff, v. ULTRA FRESH, LLC, MICHAEL FELIX, & WILLIAM HIDALGO, Defendants., No. CV1814541ESSCM, 2018 WL 6011937 (D.N.J. Nov. 16, 2018); Before the Court is Plaintiff Eagle Fruit Traders, LLC’s (“Plaintiff”) Motion for a Preliminary Injunction against Defendants Ultra Fresh, LLC (“Ultra Fresh”), Michael Felix, and William Hidalgo (collectively “Defendants”). Plaintiff seeks to enjoin Defendants from dissipating the assets of Ultra Fresh. Defendants have not opposed Plaintiff’s Motion for Preliminary Injunction, and on November 7, 2018, the Clerk of Court entered default against Defendants for failing to answer the Complaint. As such, the Court deems the Motion unopposed. This Court has jurisdiction pursuant to 7 U.S.C. § 499E (c)(5)(i) and 28 U.S.C. § 1331. Plaintiff’s Motion for Preliminary Injunction is granted.
Ausmus v. Perdue, No. 17-1442, 2018 WL 6005638 (10th Cir. Nov. 16, 2018); This is an Administrative Procedure Act challenge to the Federal Crop Insurance Corporation’s implementation of the Farm Crop Insurance Act, 7 U.S.C. §§ 1501–1524. Plaintiffs are winter wheat farmers from Colorado who were denied the Actual Production History yield exclusion when they purchased crop insurance for the 2015 crop year. Plaintiffs unsuccessfully sought review of the denial through the United States Department of Agriculture’s administrative appeals process, and then appealed to the district court. The district court reversed the USDA’s decision because it concluded that the text of the FCIA unambiguously entitled Plaintiffs to the APH yield exclusion. Exercising jurisdiction pursuant to 28 U.S.C. § 1291.  The court affirms.
