REGULATORY: EPA, FWS, FCA, NOAA

ENVIRONMENTAL PROTECTION AGENCY

Proposed rule proposing significant new use rules (SNURs) under the Toxic Substances Control Act (TSCA) for chemical substances that were the subject of premanufacture notices (PMNs). The chemical substances received “not likely to present an unreasonable risk” determinations pursuant to TSCA. Info here.

FARM CREDIT AGENCY

Notice announcing that FCA is proposing to establish a new system of records. The Health and Safety in the Workplace Records System will collect and maintain information used for ensuring workplace health and safety in response to a public health emergency, such as a pandemic or epidemic. FISH AND WILDLIFE SERVICE

Proposed rule proposing to remove the Okaloosa darter (Etheostoma okaloosae) from the Federal List of Endangered and Threatened Wildlife due to recovery. FWS’s review of the best available scientific and commercial data indicates that the threats to the species have been eliminated or reduced to the point that the species no longer meets the definition of a threatened or endangered species under the Endangered Species Act. Notice announcing that FWS received an application from PKY Clermont Owner, LLC (applicant) for an incidental take permit (ITP) under the Endangered Species Act. The applicant requests the ITP to take the federally listed sand skink incidental to construction in Lake County, Florida. FWS requests public comment on the application, which includes the applicant’s proposed habitat conservation plan (HCP), and FWS’s preliminary determination that this HCP qualifies as “low-effect,” categorically excluded, under the National Environmental Policy Act. NATIONAL OCEANIC AND ATMOSPHERIC ADMINISTRATION

Temporary rule implementing an accountability measure for the recreational sector for the other jacks complex (lesser amberjack, almaco jack, and banded rudderfish) in the South Atlantic for the 2021 fishing year. NMFS has determined that recreational landings of the other jacks complex have reached its recreational annual catch limit (ACL). Therefore, NMFS closes the recreational sector for this complex on November 17, 2021, through the remainder of the 2021 fishing year in the exclusive economic zone (EEZ) of the South Atlantic. Final rule announcing two inseason actions in the 2021 ocean salmon fisheries. These inseason actions modified the recreational ocean salmon fishery in the area from Cape Falcon, OR to the Oregon/California border. Info here.
