TAN-O-ON MARKETING, INC., and HI-LAND POTATO COMPANY, INC., Defendants, 2016 WL 3148396 (D.N.M., May 24, 2016) considered whether the court had the power under “general trust law principles” to award attorney’s fees under the Perishable Agricultural and Commodities Act (PACA). The Court did not award attorney’s fees as defendants and third-party defendants did not have a “contractual or statutory right” to them.
