The Food and Drug Administration (FDA) is implementing administrative detention authority with respect to drugs intended for human or animal use as authorized by amendments made to the Federal Food, Drug, and Cosmetic Act by the Food and Drug Administration Safety and Innovation Act. The Federal Register Notice is available here.
Administration detention is intended to protect the public by preventing the distribution or subsequent use of drugs encountered during inspections that may be adulterated or misbranded.
FDA has the authority to detain devices, tobacco, and foods that they believe has been adulterated or misbranded.
The rule is in effect June 30, 2014.
