Daniel Iverson and Wilks Ranch Montana, LTD (Wilks Ranch) appeal from a Montana Water Court order holding they failed to prove a long period of continuous nonuse and therefore failed to show Gene Klamert or his predecessors’ presumed intent to abandon the water rights. Supreme Court of Montana Affirms.
Negash v. United States, No. 18-1869, 2019 WL 2005678 (4th Cir. May 7, 2019) Israel K. Negash and Ethio, Inc. (collectively, Appellants), filed a petition pursuant to 7 U.S.C. § 2023 (2012), seeking judicial review of the United States Department of Agriculture (USDA)’s decision to permanently disqualify them from participating in the SupplementalNutrition Assistance Program (SNAP). The district court granted the USDA’s motion for summary judgment and denied the Appellants’ Fed. R. Civ. P. 59(e) motion. The Appellants contend that the district court erred in granting summary judgment prior to discovery. Court affirm the district court’s orders.

In accordance with the requirements of the Privacy Act of 1974 as amended; Section 12204 of the Agricultural Act of 2014, Rural Development (RD) gives notice of its proposal to modify the system of records entitled USDA/RD-1 Current or Prospective Producers or Landowners, Applicants, Borrowers, Grantees, Tenants, and other participants in RD programs. To communicate the revision to the USDA RD-1 Systems of Records Notice in which the addition of Routine Use 26 below is published.
However, this was not the only revised Routine Use—these were also revised:
1. Routine Use 21 was revised,
2. Routine Use 22 was added [OMB M-17-12 items],
