In the Weeds:  Legal Approaches to Dealing with Noxious Weeds on Farmland

Farmers and ranchers are familiar with noxious weeds—those invasive weeds that pose threats to the environment, people, and animals.  Noxious weeds have always been a concern for agriculture due to their ability to affect crop yields and soil and livestock health.  Nearly all states in the U.S. have enacted laws that list prohibited noxious weeds and assign responsibility for eradicating prohibited noxious weeds in certain circumstances.   These laws aim to reduce the potential of noxious weed invasions to neighboring lands.  Even so, noxious weed problems appear to be on the increase, raising questions about noxious weeds and the laws that attempt to control them.

Join us for a discussion of the factors that may be contributing to increased occurrences of noxious weed problems on farm and ranch lands, such as herbicide resistance, changing weather patterns and seed transference.  We’ll present different approaches to controlling noxious weeds, comparing and contrasting state laws that address noxious weeds in agricultural areas.  We’ll also provide recommendations for reconsidering noxious weed laws, discussing changes that may be necessary to adapt to evolving noxious weed issues.  The webinar will highlight two upcoming publications for the National Agricultural Law Center:  a state compilation of noxious weeds laws and a report that reviews and recommends legal approaches to dealing with noxious weeds and their impacts on farm and ranch lands.

Presenters:

Peggy Kirk Hall is an Associate Professor in Agricultural & Resource Law at The Ohio State University and a partner with the National Agricultural Law Center.  She is a member of OSU’s Farm Office, directs OSU Extension’s Agricultural & Resource Law Program and is the author of the Ohio Agricultural Law Blog.    Hall teaches Agribusiness Law in the College of Food, Agricultural & Environmental Sciences and has served as President of the American Agricultural Law Association and Chair of the Ohio State Bar Association Agricultural Law Committee.

Dr. Mark Loux is a Professor in the Department of Horticulture and Crop Sciences at The Ohio State University.  He conducts applied research and extension in weed management in field crops with the goal of enabling producers to make the most effective use of herbicides, minimize herbicide resistance, and reduce herbicide use through manipulation of other agronomic factors.   Current research projects include characterization and management of weed populations resistant to glyphosate and ALS-inhibiting herbicides and management of dandelion and winter annual weeds.  He is an author of the OSU Weed Control Guide for Ohio and Indiana and a regular contributor to OSU’s C.O.R.N. newsletter.
