Property Rights, Right of Ways, and Eminent Domain

Landowners are often confused when approached by powerline or pipeline companies seeking to purchase right of ways across the landowner’s property. In this webinar, Penn State Center for Agricultural and Shale staff attorney Sean High will help such landowners understand their legal rights, right of way agreements, and a company’s potential use of eminent domain. First, information will be presented regarding general property rights common to all landowners. Next, right of way agreements will be explained along with potential considerations when negotiating such agreements. Finally, the topic of eminent domain will be addressed regarding a powerline or pipeline company’s right under federal and state law to seize private land.
