A New State Law Landscape

Reed Freeman and Agriculture & AgTech Chair Karen Ellis Carr and will focus on the new state law landscape on how agricultural data ownership and monetization rights are being allocated among the various market participants, including producers, landowners, lessees, original equipment manufacturers, seed companies, aggregators, and technology providers.

Reed brings in-house, academic, government, and law firm experience in privacy, data security, data breach response, and regulatory defense to help clients in the agriculture, technology, and other industries solve their most urgent and complex issues. He has represented clients in scores of bet-the-company FTC and state investigations involving privacy and data security issues and routinely helps companies quickly investigate and recover from data breaches and manage their notification obligations. He regularly advises clients on compliance with international and domestic privacy laws and rules, including the FTC Act, Gramm-Leach-Bliley Act (GLBA) and rules, Children’s Online Privacy Protection Act (COPPA) and rule, Department of Justice Bulk Data Transfer Rule, Family Educational Rights and Privacy Act (FERPA) and rules, EU/UK General Data Protection Regulation (GDPR), California Consumer Privacy Act (CCPA) and regulations, and other state-level comprehensive privacy laws and rules. In addition, Reed helps clients navigate privacy and security issues that arise in mergers, acquisitions, and other transactional matters.
Reed is recognized in Chambers Global and Chambers USA (Band 1-National) and Legal 500 (Hall of Fame). Prior to his time in private practice, Reed served as a staff attorney in the FTC’s Bureau of Consumer Protection and as chief privacy officer and vice president for legislative and regulatory affairs for an online advertising company.
Karen Ellis Carr, Partner, ArentFox Schiff FDA Practice Leader and Agriculture & AgTech Industry Group Leader
Karen counsels, advocates, and litigates on behalf of agriculture and food companies and industry groups, with a focus on agricultural technology, food, biotechnology, pesticides and other chemical substances, and environmental law. Recognized internationally for her work on products and technologies regulated by the United States Department of Agriculture (USDA), Environmental Protection Agency (EPA), and Food and Drug Administration (FDA), Karen advises on pathways to commercialization, advertising and labeling, testing and reporting, data use and compensation disputes, and litigation relating to product approvals and agency rulemaking. She has first- and second-chaired litigation matters in state and federal trial and appellate courts throughout the country and in arbitration and mediation, and has experience in all phases of litigation, from pre-litigation strategy and counseling to settlement negotiation and appeals. She also helps clients with enforcement and other regulatory matters at the state and federal levels, and assists with risk assessment and due diligence reviews of agricultural technology companies involved in mergers, acquisitions, and other corporate transactions.
Karen is a member of the Farm Foundation Board of Directors and a Round Table Fellow. She has been recognized as one of the nation’s leading Food & Beverages: Regulatory & Litigation lawyers by Chambers USA since 2023.
